There are two methods for filing a Demand For Arbitration. A consumer may choose Filing Method A: "three times out", or Filing Method B: "30 days out-of-service". The defect or condition must be present as of the date of filing for a "three-times-out" claim. There is no requirement for a current condition for a "30 days out-of-service" claim because the defect is the repair history during the time out-of service. There are circumstances under which a Demand may be filed with fewer than three repair attempts or fewer than 30 days out-of-service as described below.
